The extradition of Terra co-founder Do Kwon has been accepted by a higher court in Montenegro, according to people with knowledge of the situation. Do Kwon and Han Chang-joon, former executives of Terraform Labs, were each given a four-month jail term in a passport falsification case, and their appeal was also rejected by the highest court in Montenegro.

According to a court document filed on November 24th, the higher court in Podgorica, Montenegro has handed down its verdict on the extradition of Terraform Labs co-founder Do Kwon.

As per the court:

“The legal prerequisites for the extradition of a citizen of the Republic of South Korea, the defendant KDH, were met, at the request of the Ministry of Justice of the Republic of Korea.”

South Korea or the United States?

Likewise, the U.S Ministry of Foreign Affairs has satisfied the necessary legal requirements for the extradition of Do Kwon. The U.S and South Korea both have a legal right to request Do Kwon’s extradition. Meanwhile, Do Kwon agreed to be deported back to South Korea.

Now, the Minister of Justice Andrej Milovic will determine which nation gets precedence in case of prospective extradition. Extraditing Do Kwon to either the United States or South Korea, as Milovic remarked yesterday on television, is a political decision that will take time.

Milovic stated:

“The USA is our main foreign policy partner, we want to sign a bilateral extradition agreement as soon as possible, in order to create a legal framework for future extraditions.” 

Terra Labs’ founder, Do Kwon, is embroiled in litigation with the U.S Securities and Exchange Commission. It is a key priority for the SEC to secure his extradition to the U.S. These steps are an attempt to start a conversation about the devastating effects on the Terra ecosystem. However, Kwon’s legal team has refused to budge, maintaining that doing so is impractical.
