Do Kwon, a co-founder of Terraform Labs, is being held in Montenegro by the Supreme Court, and has refused to extradite him to South Korea. The ruling was issued on March 22, after an aspirant’s argument that this process is outside the jurisdiction of lower courts. A motion challenging the judgment of an appellate court, which had previously rejected an appeal by Kwon’s legal team, is now scheduled to be reviewed by the Montenegrin Supreme Court.

The contention centers on the question of procedural violation, which is symbolized by the assertion that the judgment being appealed was improperly overridden by the appellate court. They claim that the Supreme Court of Montenegro is the only court with the power to issue such an order. Because of this, his transfer to South Korea keeps being delayed.

Ongoing Chaos

The Montenegrin judicial officials have had South Korean citizen Do Kwon in their custody since March 2023. His forgery of the passport led to this situation. The United States and South Korea have both made extradition demands, but they are at odds with one another. The idea of extradition to South Korea, rather than the United States, is one that Kwon’s team has publicly voiced support for.

Furthermore, the US government has charged Kwon with eight felonies, claiming that he was responsible for plotting and executing the fraud at Terraform Labs. In March 2023, these accusations were made in two separate indictments. On the other hand, he is facing charges of fraud and breaching the capital market’s regulations in South Korea. Who will carry out the extradition in the end remains an open question.
