Prosecutors in Montenegro have charged Terra’s co-founder Do Kwon and CFO Han Chang-joon on charges of document forgery. Do Kwon and Han Chang-joon were detained by Montenegrin police on March 23 for using counterfeit travel credentials to catch a trip to Dubai.
Indictments for the crime of document fabrication were brought against Do Kwon and Han Chang-joon by the Basic State Prosecutor’s Office. Local news outlet Vijesti reported on April 20 that prosecutors had also suggested extending both defendants’ jail periods.
Do Kwon and Han Chang-joon’s Montenegrin attorney had already appealed the court’s decision to prolong their imprisonment to 30 days. Despite the significance of the case, the court rejected the appeal.
Extradition Decision Post Passport Fraud Case
The extradition process would be further slowed down if the incarceration time is prolonged. The passport fabrication case now pending in a Montenegrin court must be resolved before the extradition procedure can proceed.
The extradition decision, according to Montenegro’s Minister of Justice Marko Kovac, would be made in a separate court procedure after the passport fraud case, which was announced on March 29. Crimes committed, where they were committed, the order in which extradition petitions are made, and the nationality of the accused are all relevant considerations.
At the same time, authorities in South Korea made another attempt to have co-founder Daniel Shin arrested. But the judge denied the prosecution’s plea for an arrest warrant, saying there was no reason to believe the suspect would flee or tamper with evidence. Both the U.S. and South Korean authorities want the extradition of the duo since multiple levels of charges have been leveled against them with respect to the Terra ecosystem crash that shook the crypto sector.
