BRICS Summit Arrives with President Putin’s Surrender to ICC

South Africa’s largest political party, Democratic Alliance (DA) released an application regarding the surrender of President Vladimir Putin in South Africa, this Monday. This is with regard to the presence of Putin in the upcoming BRICS summit followed by the surrender to the International Criminal Court (ICC).

The application was given to the Gauteng High Court as a request from the ICC upon the Implementation Act from the Rome Statute of ICC Act 27 of 2002. However, this proceeds with the failure of the South African government’s duty of arrest in back 2015 by the DA. Also, this is a step ahead to prevent a repetitive failure arrest of the Al-Bashir saga.

The Act of Arrest and Surrender

It is noted that President Vladimir Putin upon accusation by the ICC for the illegal war crimes and unethical practices of Ukraine people, was not arrested under the Rome Statute. The article titled 8(2) clearly picturizes the Implementation Act. 

Moreover, DA has requested in the application saying that the steps are engulfed for the surrender following the arrest from ICC. Firstly, the Justice and Constitutional Development representative Director General should right away forward the request to the Magistrate. This should be with respect to section 8(2) of the Implementation Act. Meanwhile, as per the Magistrate’s action to the request claiming a warrant of arrest, the President should be surrendered to the ICC by the Government.  

Nevertheless, the legal prosecution of this arrest and surrender is not been provided under this declaratory order. Yet, the following procedure and the upcoming obligations are meant only if President Putin appears at the forthcoming BRICS Summit planned for August in South Africa.
